Probate, Trusts and Estates

We have a very active probate practice, throughout the state of Nevada, including rural counties. We represent estates, personal representatives, spouses and other family members of the deceased. We have a specialty of ancillary probate of Nevada real estate owned by out-of-state estates at the time of the deceased’s death. Frequently these can be streamlined through set-aside proceedings without a full probate.

Bauman & Associates can also prepare the estate planning documents you need. We assist you with planning and drafting your wills, trusts and estate documents.

Trusts and Estates legal services include:

  • Preparation of wills
  • Preparation of living trusts
  • Preparation of irrevocable trusts
  • Durable power of attorney
  • Medical power of attorney / health care proxy
  • Living wills
  • Asset preservation
  • Charitable giving
  • Amendment and termination of estate planning documents
  • Quitclaim deeds to place real estate assets in trust
  • We also provide coordination for witnesses and notary public for the signing of your estate planning documents.

BENEFITS OF TRUSTS

  • Avoidance of Probate. Trusts can be used to pass assets without going through      probate. This can reduce costs and      and delay.
  • Improved Program Eligibility. Moving assets out of your name and into a trust may help      clients with the eligibility requirements necessitated for state and      federal programs such as Medicaid.
  • Tax Benefits. Irrevocable trusts can remove assets from your estate, thus      reducing estate taxes.
  • Privacy. When assets are distributed under a will, a probate      proceeding is filed, which is a public court filing. Trust documents, on      the other hand, are private.
  • Asset Protection. A properly drafted trust can help protect your assets from      creditors and ensure that they are safely transferred to your      beneficiaries.
  • Control. Living trusts can permit you to continue to control your      assets and funds during your lifetime.
